1. Services
Blue Level AI provides AI-powered business solutions, including inbound call handling, lead capture, and related services. We may introduce additional services in the future.
2. Account and Eligibility
You must be at least 18 years old and legally able to enter into contracts to use our services. You are responsible for maintaining the confidentiality of your account information.
3. Billing and Payment
All services are billed on a monthly subscription basis. Starter and Pro plans have set monthly minutes and concurrent call limits. Overage fees apply at $0.40 per additional minute. Payment is collected via Stripe or other payment processors we may offer.
4. Refund Policy
Payments are generally non-refundable. Refunds may be considered on a case-by-case basis at Blue Level AI’s discretion.
5. User Responsibilities & Acceptable Use
Blue Level AI is responsible for the technical configuration and "prompting" of the AI Agent. You agree to use these services lawfully and are responsible for: (a) the accuracy of business information provided to the AI; (b) ensuring that any lead data provided for the service was collected legally; and (c) ensuring the AI is not instructed or used to circumvent consumer protection laws. You are strictly prohibited from using the service for "spam," harassment, or prohibited industries (e.g., predatory lending, illegal substances).
6. Limitation of Liability
Blue Level AI provides services “as is” and makes no guarantees regarding performance, uptime, or results. To the maximum extent permitted by applicable law, in no event shall Blue Level AI, its officers, directors, employees, or affiliates be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
Under no circumstances will Blue Level AI be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the service or your account.
To the maximum extent permitted by law, the total aggregate liability of Blue Level AI arising out of or in connection with these terms or the use of the services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by you to Blue Level AI for the one (1) month of service immediately preceding the event giving rise to the claim.
7. Indemnification
You agree to hold Blue Level AI, its officers, directors, and employees harmless from any claims, damages, or liabilities resulting from your use of the services, your violation of these terms, or your failure to obtain proper consent for communications.
8. Changes to Terms
Blue Level AI may update these terms from time to time. Updated terms will be posted on this page with the effective date. Your continued use of the services constitutes acceptance of the updated terms.
9. Governing Law
These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of law provisions.
10. SMS & AI Communications
Blue Level AI provides the platform for AI-driven voice and SMS interactions.
